OPZIONE DEGLI ELETTORI TEMPORANEAMENTE ALL’ESTERO<\/strong><\/p>\n

\"\"<\/p>\n

Con\u00a0decreto del Presidente della Repubblica del 13\/01\/2026, pubblicato nella Gazzetta Ufficiale del 14\/01\/2026<\/strong><\/a>, \u00e8 stata fissata\u00a0nei giorni 22 e 23 MARZO 2026<\/strong>\u00a0la data del referendum ex art. 138 della Costituzione per la modifica di alcuni articoli della Costituzione (c.d. \u201cRiforma della giustizia\u201d).<\/p>\n

Gli elettori residenti in Italia<\/strong> che per motivi di lavoro, studio o cure mediche<\/strong> si trovano temporaneamente all\u2019estero per un periodo di almeno tre mesi, nel quale ricade la data di svolgimento delle prossime consultazioni referendarie ex art. 138 della Costituzione (22 e 23 marzo 2026<\/strong>), nonch\u00e9 i familiari con loro conviventi<\/strong>, potranno esercitare il diritto di voto per corrispondenza a norma dell\u2019art. 4-bis, comma 1, Legge 27 dicembre 2001, n. 459.<\/p>\n

Per ricevere il plico elettorale (contenente la scheda per il voto) all\u2019indirizzo di temporanea dimora all\u2019estero, i sopramenzionati elettori dovranno trasmettere DIRETTAMENTE <\/strong>al proprio comune d\u2019iscrizione nelle liste elettorali un\u2019apposita opzione entro mercoled\u00ec 18 febbraio 2026<\/u>. <\/strong><\/p>\n

L\u2019opzione (esercitabile tramite il modulo allegato<\/strong><\/a> o in carta libera) deve essere inviata al Comune di iscrizione nelle liste elettorali per posta, posta elettronica ordinaria o certificata. Alternativamente, pu\u00f2 essere presentata a mano, anche da una persona delegata dall\u2019interessato.<\/p>\n

L\u2019opzione, obbligatoriamente corredata di copia di valido documento d\u2019identit\u00e0 dell\u2019elettore, deve in ogni caso contenere l\u2019indirizzo postale estero completo a cui andr\u00e0 inviato il plico elettorale<\/u><\/strong> cos\u00ec come l\u2019indicazione dell\u2019Ufficio consolare competente per territorio. Essa deve inoltre contenere una dichiarazione attestante il possesso dei requisiti per l\u2019ammissione al voto per corrispondenza, ossia di trovarsi temporaneamente all\u2019estero per motivi di lavoro, studio o cure mediche per un periodo di almeno tre mesi<\/strong> (nel quale ricade la data di svolgimento delle consultazioni) in un Paese estero in cui non si \u00e8 anagraficamente residenti<\/u> oppure di essere familiare convivente di un cittadino che rientra nelle predette condizioni. Tale procedura si applica anche ai cittadini italiani iscritti all\u2019AIRE temporaneamente dimoranti in una CIRCOSCRIZIONE CONSOLARE<\/strong> diversa<\/strong> da quella di stabile residenza.<\/p>\n

L\u2019opzione va resa ai sensi degli articoli 46 e 47 del decreto del Presidente della Repubblica del 28 dicembre 2000, n. 445 (Testo Unico delle disposizioni legislative e regolamentari in materia di documentazione amministrativa), dichiarandosi consapevoli delle conseguenze penali in caso di dichiarazioni mendaci (art. 76 del citato DPR 445\/2000).<\/p>\n

\u00c8 possibile revocare <\/strong>l\u2019opzione presentata secondo le modalit\u00e0 di cui sopra entro lo stesso termine (18 febbraio 2026<\/u>). <\/strong>Si ricorda infine che l\u2019opzione \u00e8 valida esclusivamente<\/u> per la consultazione elettorale cui si riferisce.<\/p>\n

By decree of the Italian President of the Republic dated January 13, 2026, and published in the \u201cGazzetta Ufficiale\u201d on January 14, 2026,\u00a0the dates of MARCH 22 and 23, 2026,<\/strong>\u00a0have been set aside for the referendum announced pursuant to Article 138 of the Constitution, concerning amendments to certain articles of the Constitution (so-called \u201cJustice Reform\u201d).<\/p>\n

This is the text of the Referendum: Approvate il testo della legge costituzionale concernente “Norme in materia di ordinamento giurisdizionale e di istituzione della Corte disciplinare\u201d approvato dal Parlamento e pubblicato nella Gazzetta Ufficiale n. 253 del 30 ottobre 2025?<\/strong><\/p>\n

It is reminded that\u00a0VOTING is a RIGHT\u00a0<\/strong>protected by the Italian Constitution and that, pursuant to Law No. 459 of December 27, 2001, Italian citizens residing or temporarily staying abroad, registered on the electoral lists, may\u00a0VOTE BY MAIL<\/strong>, receiving their electoral package at their address of residence. To this end, it is recommended to check and, if necessary, immediately update one\u2019s personal information and address details with the competent Consular Office (under Italian law, electoral packages must be sent approximately one month before the vote in Italy), preferably using the online consular services portal\u00a0Fast It<\/strong><\/a>.<\/strong><\/p>\n

As an alternative to voting by mail,\u00a0registered AIRE electors may choose to vote in Italy<\/strong>\u00a0at their municipality of registration\u00a0by submitting their choice (OPTION) in writing to the Consulate\u00a0<\/strong>within ten days from the announcement of the referendum<\/strong>. The choice (option) to vote in Italy applies only to the specific referendum for which it is expressed.<\/p>\n

The OPTION<\/strong>\u00a0must be received by the Consular Office no later than ten days after the announcement of the consultation, i.e. in this case,\u00a0by January 24, 2026<\/strong>.<\/p>\n

For this purpose, a dedicated form is available for download from the website of the Ministry of Foreign Affairs and International Cooperation<\/strong><\/a> and from the website of the relevant Consular Office \u2013 available here<\/strong><\/a>.<\/p>\n

The completed and signed form, accompanied by valid ID, may be\u00a0submitted or sent to the relevant Consular Office in person<\/strong>, by mail, by ordinary email, or by certified electronic email (PEC).\u00a0 Relevant addresses are available on the website of the respective Consulate.<\/p>\n

The communication of the \u201cOption\u201d may also be submitted on plain paper; in any case, to be valid, it must include the elector\u2019s first name, surname, date and place of birth, place of residence and\u00a0signature<\/strong>, and must be sent together with a copy of the voter\u2019s ID.<\/p>\n

Current legislation requires electors to ensure that their postal communication of the \u201cOption\u201d has been received in due time by the relevant Consular Office. Requests received after the above deadline will not be considered valid.<\/p>\n

The choice to vote in Italy may subsequently be\u00a0REVOKED<\/strong>\u00a0by a written communication submitted to the Consular Office using the same methods and within the same deadline provided for exercising the option.<\/p>\n
